General Terms and Conditions (GTC)

Effective Date: June 1, 2025

These General Terms and Conditions (hereinafter: "GTC") apply to all products (hereinafter: "Products") available and purchasable in the online store operated by Covad Hungary Kft. (hereinafter: "Merchant" or "Seller") on the websites www.frankcalm.com, (hereinafter: "Webshop").

The Customer's order is subject to the conditions in effect in the Webshop at the time the order is placed. Pursuant to Act V of 2013 on the Civil Code (hereinafter: "Civil Code"), general terms and conditions become part of the contract if the party applying them has made it possible for the other party to become aware of their content prior to the conclusion of the contract, and the other party has accepted them. The acceptance of the GTC is a condition for any purchase in the Webshop.

2. Conclusion of the Contract

The Customer may obtain information about the essential characteristics of the product, the total purchase price (including taxes), as well as shipping fees, delivery times, and other conditions by clicking on the product name or image.

For all products offered in the Webshop, only the price displayed in the Webshop is considered valid and applicable. The Merchant expressly declares that only the data published in the Webshop are considered official and binding, and excludes liability for discrepancies appearing on other platforms.

The Customer can place the product in the virtual cart by clicking the "Add to Cart" button. On the cart page, the Customer can review and modify the order. Registration is not mandatory, but the lack of required data will prevent the completion of the purchase. The Customer is solely responsible for the accuracy of the data provided.

After providing the shipping, billing, and payment details, the Customer makes a binding offer to purchase by clicking the "Place Order" (or equivalent) button.


3. Binding Offer, Acceptance

Upon receipt of the order, the Seller sends an automatic confirmation email within 48 hours, confirming the receipt of the order. This automatic email does not constitute the acceptance of the order.

The Seller accepts the Customer's offer in a separate acceptance (or shipping confirmation) email. The contract is concluded when this acceptance email arrives to the Customer. If an error is noticed in the confirmation email, the Customer must notify customer service within 24 hours.

Consumer contracts are governed by Government Decree 45/2014 (II. 26.) and Directive 2011/83/EU of the European Parliament and of the Council.


4. Storage of Contract Data

The Seller stores the order data. The order confirmation can be printed by the Customer. All essential order data is also sent via email.


5. Right of Withdrawal

This section applies exclusively to natural persons acting for purposes outside their trade, business, craft, or profession (Consumers).

The consumer has the right to withdraw from the contract without giving any reason within 14 calendar days from the receipt of the product. The right of withdrawal can also be exercised during the period between the conclusion of the contract and the delivery of the product. The declaration of withdrawal must be made clearly via email within the withdrawal period.

The product must be returned within 14 days following the communication of the withdrawal to the following address:

The Customer bears the direct cost of returning the product.

Refunds and Depreciation: The Merchant will refund the amount paid, including the standard delivery fee, no later than 14 days after being informed of the withdrawal. The Merchant may withhold the refund until the product has been received back. The consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Please return the product, if possible, in its original condition without removing the tags.


6. Prices and Shipping Conditions

The displayed prices are gross prices and include VAT. Shipping fees are added to this, except in the case of free shipping promotions.

Delivery is available exclusively within the territory of Hungary. The exact shipping fees, delivery times, and available delivery methods are detailed in the Shipping Policy document found on the website.


7. Warranty and Guarantee

7.1. Implied Warranty: Consumers can enforce their implied warranty claims within 2 years from the date of performance (1 year for non-consumers). The Customer may request the repair or replacement of the product, unless fulfilling the chosen claim is impossible or would result in disproportionate additional costs. They may also request a price reduction or withdraw from the contract, but withdrawal is not permitted for minor defects.

7.2. Product Guarantee: Applies exclusively to consumers. The Customer may request the repair or replacement of the defective product directly from the manufacturer or distributor within 2 years of the product being placed on the market.


8. Retention of Title

The products remain the property of the Merchant until the full purchase price is paid.


9. Payment and Invoicing

Payment is possible exclusively via online bank card payment or bank transfer. Cash on delivery is not available. The Merchant reserves the right to restrict the available payment methods.

Invoices are issued electronically and sent to the provided email address.

11. Legal Remedies

In the event of a complaint, the Consumer may turn to the competent consumer protection authority or a conciliation body.

12. Data Protection

The rules concerning the processing of personal data are contained in the Privacy Policy, which is available under a separate menu item in the Webshop.


13. Unilateral Modification of the GTC

The Merchant reserves the right to unilaterally modify these general terms and conditions at any time. The modifications will only apply to orders placed after their effective date. The Merchant reserves the right to modify or suspend the operation of the Webshop without prior notice.
